   Always consult a probate attorney before assuming what assets bypass or go through probate. For the most part non-qualified annuities should by pass probate. The state of residence may have differing rules of engagement on their proprietary probate procedures.  Keep in mind that the annuity may be owner driven or annuitant driven, which can dictate the how the annuity is processed through probate.
