    The Employee Retirement Security Income Act (ERISA) governs many health insurance plans but not all. Most employer sponsored health plans are covered by ERISA expect those provided by government employers, religious organizations, and plans set up solely to comply with specific sate laws. 

    Any plan purchased on the individual market, such as plans offered through an Affordable Care Act state exchange are not subject to ERISA.
