    If you are the owner of a life insurance policy, you are the person who has all the rights to that policy, including your beneficiary. If you had life insurance on your spouse and then got divorced, you can keep that policy unless the judge rules otherwise.

    Yes, you can keep the policy on an ex-spouse however when you are divorced, you may have to take some extra steps to keep this policy from being disputed.  Each state is different however here in Colorado, unless the separated parties acknowledge that the policy is in force and wanted (outside of a court order), it could be disputed.  I would recommend talking to a divorce/family attorney to make sure you follow the steps to keep the policy in-force and avoid surprises later.

The simple answer is as long as there is still an insurable risk of loss, than yes - the two of you have kids together, business interests, etc. If there are no ties, and you made a clean break, it might be a little tougher.     Having Life Insurance on an Ex Spouse is actually pretty common and in certain situation is required by the state if there are minor children from the marriage. I have meet with many people that have gone through a divorce and we have called their ex to talk about life insurance policies from everything like college funding to burial. Most ex spouses don't have a problem with the conversation as long as it's open and honest.
