    This is a legal question, and I am not an attorney.  The policy most likely states that you cannot sue the company unless all the terms of the policy have been met.  The terms of the policy spell out your responsibilities and the company's.  On the other hand you can file suit against anyone that you want, the question is, “will you prevail?”
